Bar Rules in Missouri
Attorneys in Missouri must include a specific, “conspicuously” placed disclaimer on all law firm advertisements that must say, “The choice of a lawyer is an important decision and should not be based solely upon advertisements.” An optional inclusion is “This disclosure is required by rule of the Supreme Court of Missouri.”
Missouri requires advertising disclosures when attorneys indicate that contingency-fee arrangements are available. If legal services are available on a contingent basis, there must be a disclaimer that clearly states the client may be responsible for legal expenses.
Attorney websites may not display phrasing like “we are experts in employment law,” or “our personal injury lawyers specialize in medical malpractice.” However, they may use acceptable language like, “our law firm focuses on employment law,” or “we dedicate our practice to helping people who have suffered surgical mistakes or prescription errors.”
Neither the Supreme Court of Missouri nor the Missouri Bar do not recognize certifications of specialties. Attorneys are allowed to disclose whether they do or do not practice in particular fields of law. However, they cannot state or imply they are a specialist in a practice area without a disclaimer.
